Bram Terms of Use

These Terms of Use (“Terms”) govern your use of the Bram mobile application and related services provided by Lunar Moth Studios, LLC (“Lunar Moth Studios,” “we,” “us,” or “our”).

By downloading, accessing, purchasing, or using Bram, you agree to these Terms and the Bram Privacy Policy.

If you do not agree, do not use Bram.

1. Eligibility

You must be at least 18 years old to use Bram.

By using Bram, you represent that:

• You are at least 18.

• You have the legal capacity to agree to these Terms.

• Your use of Bram complies with applicable law.

• You will not use Bram for an unlawful, harmful, or unauthorized purpose.

2. What Bram Provides

Bram is a personal confidence-practice tool.

Bram may help you:

• Describe a social situation.

• Break a situation into a smaller action.

• Prepare possible words to use.

• Identify a safe way to reduce or leave an action.

• Reflect on an attempt.

• Record whether you tried or completed an action.

• Review a private history of attempts and progress.

Bram does not guarantee confidence, improved relationships, career advancement, social success, emotional improvement, or any other result.

3. Bram Is Not Medical or Mental-Health Care

Bram is not:

• Therapy.

• Medical or psychological treatment.

• Diagnosis.

• Crisis intervention.

• Emergency support.

• A healthcare provider.

• A substitute for a licensed mental-health or medical professional.

Bram does not establish a doctor-patient, therapist-client, counselor-client, fiduciary, or other professional relationship.

Do not use Bram to make medical decisions or as a substitute for qualified professional care.

If you may hurt yourself or someone else, feel in immediate danger, or are experiencing an emergency, stop using Bram and contact local emergency services. In the United States, call or text 988 for the Suicide and Crisis Lifeline.

4. AI-Generated Responses

Some Bram responses are generated using artificial intelligence through Firebase AI Logic and Google Gemini.

AI-generated content is probabilistic and may be:

• Incorrect.

• Incomplete.

• Repetitive.

• Inappropriate.

• Biased.

• Offensive.

• Unsafe for a particular context.

• Different from what another person would recommend.

Bram’s responses are suggestions, not instructions or professional advice.

You are responsible for evaluating every response before acting on it.

Do not rely on Bram as the sole basis for decisions involving:

• Health or safety.

• Employment.

• Education.

• Housing.

• Credit or finances.

• Legal rights.

• Immigration.

• Insurance.

• Emergency response.

• Another person’s welfare.

• Any high-impact or regulated decision.

AI systems may produce similar or identical responses for different users. We do not guarantee that any response is unique, accurate, non-infringing, or suitable for your circumstances.

5. Real-World Actions and Personal Safety

Bram may suggest actions involving conversations, public places, work, school, dating, friendships, family, boundaries, or other real-life situations.

You decide whether an action is appropriate.

Before acting, consider:

• Your physical and emotional safety.

• The location and people involved.

• Power differences.

• Workplace or school rules.

• Consent and personal boundaries.

• Local laws.

• Transportation and exit options.

• Whether professional support would be more appropriate.

You may decline an action, ask for a smaller action, request a different action, or choose “Not today.”

Do not use Bram to pressure, threaten, deceive, manipulate, stalk, harass, or endanger another person.

Lunar Moth Studios is not responsible for another person’s conduct or reaction.

6. Your Content

“User Content” means information you enter into Bram, including messages, reflections, preferences, boundaries, and other text.

You retain your rights in your User Content.

You grant Lunar Moth Studios and its service providers a limited license to host, transmit, process, reproduce, and transform User Content only as reasonably necessary to:

• Provide Bram.

• Generate requested AI responses.

• Maintain security.

• Prevent misuse.

• Provide support you request.

• Comply with law.

You represent that:

• You have the right to provide your User Content.

• Your User Content does not violate another person’s privacy or intellectual-property rights.

• You will not submit confidential third-party information without authorization.

Do not include information that is unnecessary for Bram to provide a response. Use first names, initials, or general descriptions instead of complete identifying details where possible.

7. Privacy

Your use of Bram is governed by the Bram Privacy Policy.

When you request an AI response, you direct Bram to send the text and relevant context needed for that response to Firebase AI Logic and Google Gemini.

Bram does not require a Lunar Moth Studios account. Most Bram history is stored locally on your device.

8. License to Use Bram

Subject to these Terms, Lunar Moth Studios grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Bram for your personal, non-commercial use on Apple devices that you own or control.

You may not:

• Copy, sell, rent, sublicense, or redistribute Bram.

• Modify or create derivative works from Bram except where applicable law permits.

• Reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits.

• Bypass subscription, security, usage, or access controls.

• Scrape or automatically collect content from Bram.

• Use Bram or its outputs to train or develop a competing AI model or service.

• Remove copyright, trademark, or ownership notices.

Bram, its software, visual design, character artwork, branding, prompts, response systems, and related content are owned by Lunar Moth Studios or its licensors and are protected by intellectual-property laws.

9. Subscriptions and Free Trials

Bram may require an auto-renewing subscription for access to its features.

Subscription information, including the price, billing period, trial eligibility, and renewal terms, is displayed before purchase.

Billing

Purchases are processed by Apple through your Apple Account. Lunar Moth Studios does not directly process your payment card.

Free Trials

A free trial may be available only to eligible Apple Accounts. Eligibility is determined by Apple and may vary.

Unless canceled before the trial ends, the subscription automatically converts to a paid subscription at the price shown before confirmation.

Automatic Renewal

Subscriptions renew automatically unless canceled through your Apple Account.

You can manage or cancel a subscription in Apple’s subscription settings. Deleting Bram or deleting local Bram data does not cancel a subscription.

Restoring Purchases

Bram includes a Restore Purchases option. Purchase restoration is subject to your Apple Account, Apple’s services, and RevenueCat’s subscription-verification system.

Refunds

Refund requests are handled by Apple and are subject to Apple’s policies and applicable law. Lunar Moth Studios cannot directly issue an App Store refund.

Price Changes

Apple will provide notice or request consent for subscription price changes when required by Apple’s policies or applicable law.

10. Acceptable Use

You may not use Bram to:

• Violate a law or regulation.

• Harm, threaten, abuse, exploit, harass, or deceive another person.

• Encourage violence, self-harm, or dangerous conduct.

• Generate or distribute unlawful content.

• Infringe privacy, intellectual-property, publicity, or other rights.

• Submit malware or malicious instructions.

• Circumvent security or access controls.

• Interfere with Bram’s operation.

• Probe, scan, or test Bram’s infrastructure without authorization.

• Fraudulently obtain subscription access.

• Misrepresent AI-generated content as professional advice.

• Use Bram in a clinical, medical, emergency, or regulated decision-making system.

• Use Bram to develop a competing model, service, or dataset.

• Attempt to discover private system instructions, credentials, or security controls.

We may restrict or suspend access when reasonably necessary to prevent harm, comply with law, enforce these Terms, or protect Bram and its providers.

11. Third-Party Services

Bram depends on third-party services, including:

• Apple and the App Store.

• Google Firebase.

• Firebase AI Logic.

• Google Vertex AI and Gemini.

• RevenueCat.

Third-party services may experience outages, errors, delays, policy changes, pricing changes, model changes, or discontinuation.

Their own terms and privacy policies may apply.

We do not control and are not responsible for third-party services, except to the extent applicable law provides otherwise.

12. Availability and Changes

We may:

• Modify Bram.

• Add or remove features.

• Change AI models or service providers.

• Introduce usage limits.

• Correct errors.

• Suspend features for maintenance or security.

• Discontinue Bram or part of Bram.

We do not guarantee that Bram will always be available, uninterrupted, secure, or compatible with every device or operating-system version.

Where required, material changes affecting an active paid subscription will be communicated through the App, App Store, website, or another reasonable method.

13. Feedback

If you provide suggestions, ideas, or feedback about Bram, you grant Lunar Moth Studios a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation.

This does not grant us ownership of your private Bram entries.

14. Termination

You may stop using Bram at any time.

You may delete local Bram data through the App or remove the App from your device.

Removing Bram does not automatically cancel an Apple subscription.

We may suspend or terminate access if:

• You materially violate these Terms.

• Your use creates a security, legal, or safety risk.

• A service provider requires suspension.

• We are required to do so by law.

• Bram is discontinued.

Provisions that should reasonably survive termination will survive, including provisions concerning ownership, payment obligations, disclaimers, liability, disputes, and your responsibilities.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

LUNAR MOTH STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY.

WE DO NOT WARRANT THAT:

• BRAM WILL BE UNINTERRUPTED OR ERROR-FREE.

• AI RESPONSES WILL BE ACCURATE, COMPLETE, SAFE, OR APPROPRIATE.

• SUGGESTED ACTIONS WILL PRODUCE A POSITIVE RESULT.

• USE OF BRAM WILL IMPROVE CONFIDENCE, ANXIETY, RELATIONSHIPS, EMPLOYMENT, EDUCATION, OR WELL-BEING.

• INFORMATION WILL NEVER BE LOST.

• THIRD-PARTY SERVICES WILL REMAIN AVAILABLE.

• BRAM WILL IDENTIFY EVERY SAFETY RISK OR EMERGENCY.

Some jurisdictions do not permit certain warranty disclaimers. In those jurisdictions, these disclaimers apply only to the maximum extent permitted by law.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNAR MOTH STUDIOS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES LOSS ARISING FROM:

• USE OR INABILITY TO USE BRAM.

• RELIANCE ON AN AI RESPONSE.

• A REAL-WORLD ACTION OR INTERACTION.

• ANOTHER PERSON’S CONDUCT.

• LOSS OF DATA.

• SERVICE INTERRUPTION.

• DEVICE FAILURE.

• SUBSCRIPTION OR BILLING ISSUES.

• UNAUTHORIZED ACCESS.

• THIRD-PARTY SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM BRAM WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID FOR BRAM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

• ONE HUNDRED U.S. DOLLARS.

Nothing in these Terms excludes liability that cannot legally be excluded, including rights available under applicable consumer-protection law.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lunar Moth Studios and its owners, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• Your unlawful or unauthorized use of Bram.

• Your User Content.

• Your material violation of these Terms.

• Your violation of another person’s rights.

• Your intentional misuse of an AI response.

• Your use of Bram to harm, deceive, harass, or endanger another person.

This section does not apply where prohibited by applicable consumer law.

18. Apple Terms

Bram is distributed through Apple’s App Store.

Your license to use Bram is also subject to Apple’s applicable terms, including Apple’s Standard Licensed Application End User License Agreement. Apple Standard EULA

These Terms are between you and Lunar Moth Studios, not Apple.

Apple is not responsible for:

• Providing maintenance or support for Bram.

• Addressing claims relating to Bram.

• Bram’s compliance with law.

• Bram’s content or services.

Apple and its subsidiaries are intended third-party beneficiaries of these Terms as they relate to your license to use Bram and may enforce those provisions.

If these Terms conflict with Apple’s mandatory terms, Apple’s mandatory terms control to the extent of that conflict.

19. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

To the extent permitted by law, disputes relating to Bram or these Terms will be brought in the state or federal courts located in Massachusetts.

This section does not prevent you from exercising rights or filing claims in your local jurisdiction where applicable consumer law gives you that right.

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain effective. The unenforceable provision will be enforced to the maximum extent permitted by law.

21. Entire Agreement

These Terms, the Bram Privacy Policy, Apple’s applicable terms, and any additional terms presented at purchase form the agreement between you and Lunar Moth Studios concerning Bram.

22. Changes to These Terms

We may update these Terms when Bram, our providers, or legal requirements change.

The updated Terms will be posted with a revised effective date. We will provide additional notice when required by law.

Continued use after updated Terms take effect constitutes acceptance where permitted by law.
